EuropeInns Terms and Conditions Tulkki Web Services (TWS) offers a directory service for accommodations located in European countries. This service, called EuropeInns, is offered on the website on the web domains europeinns.com and franceinns.com. Browsing on EuropeInns is free of charge (excluding the internet access). EuropeInns may install the following cookies on the visitor's computer: - the member area ID cookie to allow identification of the member. - the DoubleClick DART cookie installed by the Google AdSense service. These cookies are not meant to collect any personal data from the user and can be deleted easily in the user's web browser's settings. Users can deactivate the DART cookie on the Google Ad Privacy page. Publishing data on EuropeInns In order to get listed in EuropeInns, the advertiser has to agree to the following Terms and Conditions, referred to herein collectively as the Agreement. TWS makes no warranties, express or implied, other than those presented in this Agreement. TWS reserves the right to refuse any listing for any reason. TWS shall be the sole and final arbitrator of whether or not any listing material is appropriate for inclusion on EuropeInns. TWS reserves the right to discontinue listings for any accommodation in the event that TWS has received more than one unresolved complaint, or for any other reasonable grounds, solely within the discretion of TWS. Advertiser is solely responsible for any legal liability arising out of or relating to the listing, any claims or misrepresentations made via the listing, and/or any material to which users can link through the Advertisement. Advertiser represents and warrants that: the material provided to TWS is original, copyrighted material belonging to Advertiser, or that Advertiser has obtained any and all rights, permissions and licenses necessary for TWS to use the material in the preparation of Advertiser's listing-pages; the use, reproduction, distribution, or transmission of the listing will not violate any criminal laws or any rights, title or interests of any third party, including, but not limited to, copyright (whether in text, image, software code or music), patent, trademark, trade secret, or any other proprietary or property right; and that the listing will not contain material that includes false advertisements, unfair competition, defamatory material, invasions of privacy or rights of celebrity, or violations of any anti-discrimination law or regulation. Advertiser agrees to indemnify and hold TWS, its assigns, employees, and heirs, harmless from any and all liability, loss, damages, claims, or causes of action, and/or third party claims, arising out of or related to Advertiser's breach of any of the foregoing representations and warranties, including reasonable legal fees and expenses. The data publishing rules applied to "Travel Tips" are the same as for accommodation listings. The Advertiser has to provide a valid e-mail address to contact him regarding his information on EuropeInns. He may choose to let EuropeInns users to contact him via that e-mail or not by activating/deactivating the contact form on his accommodation's page from the Member Area. TWS reserves the right to delete any accounts with an invalid e-mail address without any notice. Payments on EuropeInns In addition to the free services provided by EuropeInns, Advertisers may choose to pay to the following services: - "Express listing": the Advertiser can make his accommodation appear on the website immediately and not wait until TWS verifies his data. The listing will be checked afterwards by TWS. If TWS refuses the listing afterwards, all the payments will be fully reimbursed to the Advertiser. - "Purchasing points": to increase his listing's rank in EuropeInns, the Advertiser can purchase points for the price indicated in the Member area. The purchased points have no expiry date and will stay on the Advertiser's listing. Points can't be transferred to another Advertiser. No reimbursements will be made on purchased points once they are credited on the Advertiser's listing, unless a human error reported at maximum 5 working days after the purchase. - "Sponsoring": the Advertiser can make his accommodation more visible by sponsoring some of the pages of the website. Sponsoring is always concluded for a determined amount of time and can be purchased only with PayPal payment. TWS's engagement TWS will keep the Advertiser's e-mail address only as a mean of contact between TWS and the Advertiser and will not sell or give it to other parties. If the Advertiser chooses to, his accommodation's listing page can include a contact form sending mails to this address but the e-mail will never be shown on the website to avoid spam. TWS will not sell any of the data of the Advertiser to any other party. However, most data will be accessible directly on EuropeInns (except the e-mail address) and TWS can't be held responsible for the consequences of this publication. This Agreement will be governed by and construed in accordance with the laws of France. By registering his accommodation to EuropeInns, the Advertiser agrees to this Agreement. |
